New Michigan “Red Flag” Laws: Safe Storage Of Firearms & Background Check Legislation

Two new gun safety bills were signed into law by Michigan Governor Gretchen Whitmer on April 13th. The first stipulates safe storage requirements for firearms in homes where minors may be present. The second law requires background checks and registration for firearms purchased at gun shows and in private sales.

Both bills were signed into laws on the heels of the February 13 mass shooting on the MSU campus in East Lansing. A third bill awaits approval in the state Senate. If passed, the law would allow medical professionals, romantic partners, roommates, law enforcement and others to petition a judge to remove firearms from individuals who are believed to be a danger to themselves or others.

Michigan’s New Safe Gun Storage Law

Beginning next year, Michigan gun owners will be required to keep their firearms locked away and/or unloaded with a trigger or cable lock when minors are present. Failure to properly store a gun in accordance with these requirements could lead to a felony charge if a minor uses the gun to kill or injure themselves or others.

Background Check Legislation Requires Individuals To Register Firearms In Private Sales

New background check legislation will require gun retailers to conduct a background check and register the firearm with law enforcement when selling at gun shows. In a private sale, the responsibility to register the gun will fall on the recipient.
